Momo™ is provided by Momo Technologies, Inc. Throughout this document, we use the terms "Momo", "we”, "us", and "our" interchangeably to refer to Momo Technologies, Inc. Our Services are hosted within the People’s Republic of China.
We provide services to you through our mobile application and other related services (collectively, such services, including any new features and applications associated with Momo™), subject to the following Terms of Service (as amended from time to time, the "Terms of Service" or "Terms"). We reserve the right to change, modify, or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. If we do this, we will post the changes to these Terms of Service on this page and will indicate at the top of this page the date these terms were last revised. You should periodically visit this page to review the current Terms so you are aware of any revisions. By continuing to use the service, you agree to be bound by these changes. If you do not agree to abide by these changes or any future Terms of Service revisions, please do not use or access (or continue to use or access) the service.
Furthermore, when using certain services, you will be subject to any additional terms applicable to such services that may be posted on this page from time to time, including, and not limited to, the Privacy Policy, located at http://www.immomo.com/privacy.html. All such terms are hereby incorporated by reference into these Terms of Service.

Access and Use of the Service

Services Description: The Service is designed to help you find unknown people nearby, by displaying profiles and other information about these unknowns around you on your mobile device.
In order to do this, we require the use of such information including, but not limited to, your facebook® account and/or your location (as determined by the GPS coordinates of your mobile device). Use of this information is governed by our Privacy Policy, located at http://www.immomo.com/privacy.html, which we strongly encourage you to read carefully.
Your Registration Obligations: You may be required to register with Momo™ in order to access and use certain features of the service. If you choose to register for the service, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the service's registration form. Registration data and certain other information about you are governed by our Privacy Policy.
Member Account, Password and Security: You are responsible for maintaining the confidentiality of your password and account and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify Momo™ of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Service. Momo™ will not be liable for any loss or damage arising from your failure to comply with this agreement.

Children's information

Momo™ does not knowingly collect personal information from children under the age of 12. If you are under the age of 12, please do not submit any personal information through the service. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal information on this service. If you have reason to believe that a child under the age of 12 has provided personal information to Momo™ through this service, please contact us and we will endeavor to delete that information from our databases.

facebook® Authentication

In order to make your experience more personalized and to authenticate you with the service, the service requires you to sign in with your facebook® account. You may be asked to sign in with the service directly on facebook®. Your authorization of facebook® will provide us with access to a subset of your facebook® profile data and other information that you have made available to facebook®.
We will use, store and disclose such information in accordance with our Privacy Policy. For more information about the implications of activating facebook® and Momo™s use, storage and disclosure of information related to you and your use of such services within Momo™ (including your friend lists, photo[s], and the like), please see our Privacy Policy, located at http://www.immomo.com/privacy.html. However, please remember that the manner in which facebook® uses, stores and discloses your information is governed solely by its policies, and Momo™ shall have no liability or responsibility for the privacy practices or other actions of any third party site or service that may be integrated and/or connected with the service.
Momo™ is not responsible for the accuracy, availability or reliability of any information, content, goods, data, opinions, advice or statements made available through your authorization of facebook®. As such, Momo™ is not liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on facebook®. Momo™ enables these features for your convenience and we do not explicitly endorse or recommend facebook® or other third party websites.

Third Party Sites and Services.

Our Service may permit you to link to other websites, services or resources on the Internet. When you access third party websites, you do so at your own risk. These other websites are not under Momo's™ control, and you acknowledge that Momo™ is not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply endorsement by Momo® or any association with its operators. Furthermore, you acknowledge and agree that Momo™ shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such third party websites or resources.

Termination

We reserve the right to terminate or suspend your account (or any part thereof) for any reason and without notice. We may also remove and discard any content within the service, for any reason, including, without limitation, for lack of use or if Momo™ believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Service. Momo™ may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. Any suspected violation of our terms may be grounds for termination of your use of the service , in some cases, termination means your device can no longer use our service and may be referred to appropriate law enforcement authorities.
You agree that any termination of your access to the service under any provision of this Terms of Service may be initiated without prior notice and acknowledge and agree that Momo™ may immediately deactivate or delete your account and all related information, files in your account and/or bar any further access to such files or the service. Further, you agree that Momo™ will not be liable to you or any third-party for any termination of your access to the service.

Violations (Including but not limited to)

1. criminal or tortuous activity, including, but not limited to, child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
2. advertising to, or solicitation of, any member to buy or sell any products or services through the unauthorized or impermissible use of Momo™ services. You may not transmit any chain letters or junk email to other members. In order to protect our members from such advertising or solicitation, Momo™ reserves the right to restrict the number of messages which a member may send to other members in any period to a number which Momo™ deems appropriate in its sole discretion. If you breach this agreement and send unsolicited bulk email, instant messages or other unauthorized commercial communications of any kind through the Momo™ services, you acknowledge that you will have caused substantial harm to Momo™, but that the amount of such harm would be extremely difficult to ascertain.
3.circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the Momo™ services;
4. activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network;
5. covering or obscuring any banner advertisements on your personal profile page, or any Momo™ page via HTML/CSS or any other means;
6. any automated use of the system, such as, but not limited to, using scripts to send comments or messages;
7. interfering with, disrupting, or creating an undue burden on the Momo™ services or the networks or services connected to the Momo™ services;
8. impersonating or attempting to impersonate another member, person or entity;
9. using the account, username, or password of another member at any time or disclosing your password to any third party or permitting any third party to access your account;
10. selling or otherwise transferring your profile;
11. using any information obtained from the Momo™ services in order to harass, abuse, or harm another person or entity, or attempting to do the same;
12. displaying an unauthorized commercial advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity through the unauthorized or impermissible use of the Momo Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, or sending private messages with a commercial purpose;
13. using the Momo™ services in a manner inconsistent with any and all applicable laws.

Content.

All content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such content. Momo™ cannot guarantee the authenticity of any Content or data which users may provide about themselves or others. You acknowledge that all content accessed by you using the service is at your own risk and you will be solely responsible and liable for any damage or loss to you or any other party resulting there from. For purposes of these Terms of Use, the term "content" includes, without limitation, any location information, text, videos, audios, comments, information, data, photographs, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible by Momo on or through the service. Content added, created, uploaded, submitted, distributed, or posted to the service by users is collectively referred to as, "user submissions."

Momo™ Content.

The Service contains Content specifically provided by Momo™ or its partners and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws, as applicable. You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Service.
